 DEVELOPMENT REGULATIONS, CURRENT EDITION
 TO WHOM IT MAY CONCERN:
 THIS OFFICE HAS REVIEWED THE APPLICATION FOR
 CONCURRENCY CLEARANCE AND OTHER SUPPORTING DOCUMENTS
 SUBMITTED FOR THE ABOVE-INDICATED PROJECT. THIS OFFICE
 IS APPROVING THE ISSUANCE OF THE CERTIFICATE OF
 CONCURRENCY SUBJECT TO THE CONDITIONS LISTED BELOW:
 1. DEDICATION OF A 100-FOOT RIGHT-OF-WAY FOR A 4-LANE
 URBAN COLLECTOR ROAD (INCLUDING A 10’ PATH) FROM US HWY
 27 AT THE INTERSECTION OF TOMOKA BOULEVARD SOUTH TO THE
 EXISTING ST. JOHN STREET RIGHT-OF-WAY.
 2. ON ST. JOHN STREET, DEDICATION OF SUFFICIENT LAND
 FOR A 130’ RIGHT-OF-WAY (WHEN COMBINED WITH EXISTING
 RIGHT-OF-WAY) FOR A 4-LANE URBAN COLLECTOR ROAD
 EXTENDING ALONG THE EASTERN BOUNDARY OF THE PROPERTY
 LINE TO THE NORTHEAST CORNER OF THE SUBJECT PROPERTY
 FOR WHICH AN EASEMENT AGREEMENT WITH THE COUNTY WILL BE
 REQUIRED. THE DEVELOPER SHALL (IF WARRANTED BY FLORIDA
 DEPARTMENT OF TRANSPORTATION (FDOT)) INSTALL A TRAFFIC
 SIGNAL ON US HIGHWAY 27 AT TOMOKA BOULEVARD SOUTH.
 3. PLEASE NOTE THE COUNTY SHALL NOT BE FISCALLY
 RESPONSIBLE FOR IMPROVEMENTS SUCH AS TRAFFIC SIGNALS
 AND RELOCATION OF UTILITY POLES IN THE PRESENT OR
 FUTURE. A DEVELOPMENT ORDER/ROADWAY CONNECTION PERMIT
 WILL NOT BE ISSUED UNTIL ALL CONDITIONS ARE SATISFIED.

 SHOULD FDOT REQUIRE A TRAFFIC SIGNAL IN CONJUNCTION
 WITH THIS PROJECT, THE OWNER SHALL BE RESPONSIBLE FOR
 ALL COST ASSOCIATED WITH DESIGN AND CONSTRUCTION OF
 SAID TRAFFIC SIGNAL. 4. THE APPLICANT SHALL BE
 RESPONSIBLE FOR THE RELOCATION OF ANY EXISTING POWER
 POLES THAT CONFLICT WITH NEW ROADWAY CONNECTION FROM
 THE EXISTING ST. JOHNS STREET TO US 27.
 5. PLEASE PROVIDE COPIES OF ALL SUBMISSIONS TO FDOT
 (I.E. TRAFFIC STUDY, SIGNAL WARRANT ANALYSIS, ICE
 ANALYSIS).
 6. A COUNTY ROADWAY/DRIVEWAY CONNECTION PERMIT WILL BE
 REQUIRED FOR ANY PROPOSED CONNECTIONS TO ST. JOHN
 STREET. PLEASE NOTE THAT FOR ANY DEFICIENCIES
 IDENTIFIED IN THE TRAFFIC STUDY, APPROPRIATE
 IMPROVEMENTS TO MITIGATE DEFICIENCIES WILL NEED TO BE
 COMPLETED OR SATISFACTORILY ADDRESSED PRIOR TO ISSUANCE
 OF THE ROADWAY/DRIVEWAY CONNECTION PERMIT TO ST. JOHN
 STREET.
 7. PLEASE NOTE THAT ADDITIONAL RIGHT OF WAY MAY BE
 REQUIRED TO SATISFY THE HIGHLANDS COUNTY LAND
 DEVELOPMENT REGULATIONS MINIMUM RIGHT-OF-WAY
 REQUIREMENTS, OR A FUNCTIONAL CLASSIFICATION SETBACK
 MAY BE REQUIRED.
 8. PLEASE NOTE THAT THE SITE ACCESS AND CIRCULATION FOR
 A PROPOSED DEVELOPMENT SHALL BE CONSISTENT WITH THE
 REQUIREMENTS OF 12.09.103 ACCESS AND CIRCULATION, OF
 THE HIGHLANDS COUNTY LAND DEVELOPMENT REGULATIONS,
 CURRENT EDITION. THE SITE ACCESS PLAN SHALL BE SUBJECT
 TO THE COUNTY ENGINEER'S REVIEW AND APPROVAL. THIS
 REVIEW SHALL BE MADE ACCORDING TO CURRENTLY ACCEPTED
 TRAFFIC ENGINEERING PRINCIPLES.
 9. SIDEWALKS MAY BE REQUIRED ALONG ARTERIAL AND/OR
 COLLECTOR ROADS AT THE TIME OF THE ROADWAY/DRIVEWAY
 CONNECTION PERMIT APPLICATION.
 PLEASE NOTE THE FOLLOWING:
 TRANSPORTATION CONCURRENCY (PLANNING ELEMENT)
 (TRANSPORTATION) CONCURRENCY APPROVAL IS BASED ON A
 PROJECT’S POTENTIAL IMPACT TO THE SURROUNDING ROADWAY
 SYSTEM. CONCURRENCY IS A PLANNING ELEMENT, NOT A DESIGN
 ELEMENT. CONCURRENCY ONLY DETERMINES IF ADEQUATE
 FACILITIES ARE AVAILABLE OR NEED TO BE PROVIDED BY THE
 APPLICANT OR OTHERS.
 TRANSPORTATION DESIGN (SITE ACCESS & OFF-SITE
 IMPROVEMENT DESIGN ELEMENT)
 UPON COMPLETION OF THE PLANNING ELEMENT, THE APPLICANT
 SHALL SUBMIT A DESIGN ANALYSIS DOCUMENTING THE DESIGN
 CRITERIA, STANDARDS, ETC. TO BE USED TO DESIGN THE SITE
 ACCESS AND ANY REQUIRED OFF-SITE IMPROVEMENTS.
 APPROPRIATE ANALYSES SUCH AS HIGHWAY CAPACITY MANUAL
 INTERSECTION ANALYSES, DESIGN CALCULATIONS FOR SIGHT
 DISTANCE, ETC. SHOULD BE DOCUMENTED WITHIN THE
 TRANSPORTATION DESIGN ELEMENT.
