C-20-34-28-A00-0011-0000 (“PROPERTY”).
2. PETITIONER HAS JURISDICTION OVER THE
PROPERTY AND THE SUBJECT MATTER OF CASE
NUMBER CE24050070 PURSUANT TO CHAPTER
162, FLORIDA STATUTES AS THE PROPERTY IS
LOCATED IN UNINCORPORATED HIGHLANDS
COUNTY.
3. ON AUGUST 13, 2024, PETITIONER ISSUED
CITATION NUMBER 24050070B (”CITATION”)
IMPOSING A FINE IN THE AMOUNT OF $100.00
FOR VIOLATION OF HIGHLANDS COUNTY CODE
OF ORDINANCES, SECTION 12.10.218. THE
CITATION REQUIRED PETITIONER TO CEASE
USING
A RECREATIONAL VEHICLE (RV) FOR LIVING
PURPOSES ON THE PROPERTY AND REMOVE THE
RV AND TRAILERS ON THE PROPERTY BY
SEPTEMBER 12, 2024.
4. ON OR ABOUT SEPTEMBER 17, 2024,
PETITIONER CONTESTED THE CITATION
THROUGH THE
FILING OF THE HIGHLAND COUNTY FORM FOR
CONTESTING CITATION BEFORE SPECIAL
MAGISTRATE, RESULTING IN THE PENDING
ADMINISTRATIVE PROCEEDING IN CASE NUMBER
CE24050070.
OW THEREFORE, IT IS HEREBY ORDERED AND
ADJUDGED, THAT PETITIONER AND
RESPONDENT AGREE TO RESOLVE ALL CLAIMS
AND DISPUTE BETWEEN THEM IN THE ABOVE
STYLED CAUSE BASED
ON THE FOLLOWING TERMS:
1. RESPONDENT IS ORDERED TO REMEDY THE
CITATION AND BRING THE PROPERTY INTO
COMPLIANCE PURSUANT TO THE FOLLOWING
SCHEDULE:
A) WITHIN THREE (3) MONTHS OF THE DATE
OF THIS CONSENT ORDER
RESPONDENT SHALL SECURE A BUILDING
PERMIT FOR CONSTRUCTION OF A
SINGLE-FAMILY RESIDENCE ON THE PROPERTY.
B) WITHIN EIGHTEEN (18) MONTHS OF THE
DATE OF THIS CONSENT ORDER (THE
“COMPLIANCE DATE”) RESPONDENT SHALL
OBTAIN A CERTIFICATE OF
OCCUPANCY FOR THE CONSTRUCTION OF A
SINGLE-FAMILY RESIDENCE ON THE
PROPERTY (“FINAL COMPLIANCE DATE”).
2. RESPONDENT SHALL BE PERMITTED TO
MAINTAIN THE RV ON THE PROPERTY SO LONG
AS
RESPONDENT SECURES A BUILDING PERMIT AS
SET FORTH ABOVE AND THEREAFTER IS
ACTIVELY
PURSUING CONSTRUCTION OF THE
SINGLE-FAMILY RESIDENCE ON THE PROPERTY
SO THAT A
CERTIFICATE OF OCCUPANCY CAN BE RECEIVED
WITHIN EIGHTEEN (18) MONTHS OF THE DATE
OF THIS CONSENT ORDER.
3. RESPONDENT SHALL PAY THE FINE IMPOSED
BY THE CITATION IN THE AMOUNT OF
$100.00.
PETITIONER ACKNOWLEDGES THAT RESPONDENT
PAID $50.00 TO INITIATE AN APPEAL OF THE
CITATION AND HAS AGREED TO APPLY SAID
AMOUNT TO THE FINE IMPOSED BY THE
CITATION.
THE REMAINING AMOUNT OF $50.00 SHALL BE
PAID WITHIN THIRTY (30) DAYS OF THE DATE
OF THIS ORDER. PAYMENT SHALL BE MADE TO
THE COUNTY CODE ENFORCEMENT
DEPARTMENT, 501 S. COMMERCE AVENUE,
SEBRING, FLORIDA 33870.
4. RESPONDENT SHALL PAY PETITIONER’S
ADMINISTRATIVE COSTS, BUT NOT ATTORNEYS’
FEES, IN
THE AMOUNT OF $645.51, WHICH SHALL BE
PAID WITHIN THIRTY (30) DAYS OF THE DATE
OF
THIS ORDER.
5. RESPONDENT SHALL INCUR A FINE IN THE
AMOUNT OF TWO HUNDRED FIFTY AND 00/100
DOLLARS ($250.00) PER DAY FOR EACH DAY
THAT THE VIOLATION REMAINS AFTER THE
FINAL
COMPLIANCE DATE UNLESS OTHERWISE AGREED
TO BY THE PARTIES OR BY FURTHER ORDER OF
THIS MAGISTRATE IN ACCORDANCE WITH THIS
ORDER.
6. AFTER COMPLIANCE IS ACHIEVED, ANY
REPEAT VIOLATION, AS DEFINED BY CHAPTER
162,
FLORIDA STATUTES, MAY RESULT IN THE
ASSESSMENT OF A CIVIL PENALTY UP TO AN
AMOUNT OF
$500.00 PER DAY.
7. FROM THE DATE OF THIS ORDER UNTIL THE
COMPLIANCE DATE, PETITIONER SHALL NOT
ISSUE
ANY WARNING, CITATION, OR NOTICE OF
VIOLATION AGAINST PETITIONER SOLELY
RELATED TO THE
MATTERS CONTAINED IN THIS ACTION.
RESPONDENT'S COMPLIANCE WITH THE TERMS
OF THIS
ORDER SHALL FULLY AND FINALLY RESOLVE
THE CLAIMS OF PETITIONER AGAINST
RESPONDENT AS
CHARGED UNDER HIGHLANDS COUNTY CODE
ENFORCEMENT CASE NUMBER: CE24050070,
AND EACH PARTY WAIVES ITS RIGHT TO
CHALLENGE OR CONTEST THE VALIDITY OF
THIS ORDER.
8. THIS CONSENT ORDER IS THE WHOLE
AGREEMENT OF THE PARTIES, BINDING THEM
AND ANY
SUCCESSOR, ASSIGNEE, OR LOCAL
REPRESENTATIVE. THERE ARE NO PROMISES,
TERMS,
CONDITIONS, OR ALLEGATIONS OTHER THAN
THOSE CONTAINED IN THIS CONSENT ORDER
AND
ANY ATTACHMENTS TO IT. THIS DOCUMENT
WITH ANY ATTACHMENTS ALSO SUPERSEDES ALL
PREVIOUS COMMUNICATIONS,
REPRESENTATIONS, OR AGREEMENTS, WHETHER
WRITTEN OR
VERBAL, BETWEEN THE PARTIES.
9. RESPONDENT WILL NOTIFY PETITIONER OF
ANY ISSUE THAT MATERIALLY AFFECTS ITS
COMPLIANCE OBLIGATIONS ARISING UNDER
THIS ORDER. IF THERE ARE MATERIAL
CHANGES,
OUTSIDE OF RESPONDENT’S CONTROL OR WHICH
ARE NOT CAUSED BY RESPONDENT, THE
PARTIES WILL WORK COOPERATIVELY TO
ATTEMPT TO AGREE TO PROPOSED
MODIFICATIONS TO
THE CONSENT ORDER WHICH WILL BE BROUGHT
TO THE MAGISTRATE FOR ENTRY. IF THE
PARTIES
FAIL TO REACH AN AGREEMENT AS TO ANY
MODIFICATIONS TO THIS CONSENT ORDER,
EITHER
PARTY MAY FILE A MOTION TO BE DECIDED BY
THE MAGISTRATE. THE MAGISTRATE SHALL
RETAIN JURISDICTION OVER THIS MATTER TO
ENFORCE THE TERMS OF THIS CONSENT ORDER
AND
ANY MODIFICATIONS HERETO.
10. THE PARTIES WILL BEAR THEIR OWN
ATTORNEY’S FEES. NO FINANCIAL CLAIM
BASED ON THIS
ACTION SHALL BE MADE AGAINST THE COUNTY.
