COMPLAIN ABOUT CONTRACTOR WHO REFUSES TO
REPAIR THE CONCRETE DRIVEWAY. THEY
SHOWED ME PICTURES OF AREAS OF CONCRETE
WITH TROWEL MARKS, UNSMOOTH FINISH AND
FLAKING OF CONCRETE. THEY REPORTED
VERBAL CONFRONTATION WITH CONTRACTOR. I
LATER CALLED THE CONTRACTOR TO INQUIRE
WHAT OPTIONS WERE AVAILABLE TO REPAIR
THE CONCRETE. GRINDING OUT THE FLAWS
WILL LEAVE THE DRIVEWAY WITH A SMOOTH
FINISH WHICH COULD BE A HAZARD. GRINDING
AND APPLICATION OF NON-SKID FINISH MAY
BE A POSSIBILITY. CONTRACTOR REPORTS
THAT MULTIPLE THREATS OF LAWSUIT HAVE
CAUSED HIM TO BE RELUCTANT TO DO ANY
MORE WORK FOR THIS CUSTOMER. I MADE SITE
VISIT TO INSPECT THE WORK. IT IS MY
OPINION THAT THE AREAS IN DISPUTE ARE
NOT STRUCTURAL DEFICIENCIES AND ARE
COSMETIC CONCERNS. I WOULD ENCOURAGE THE
CUSTOMER AND THE CONTRACTOR TO NEGOTIATE
A SETTLEMENT THAT WOULD INCLUDE GRINDING
AND BUFFING OF THE AREAS IN DISPUTE AND
APPLICATION OF A NON-SKID SEALANT. MY
SUGGESTION WOULD BE THAT THE CONTRACTOR
BUFF THE AREAS IN DISPUTE AND PAY THE
OWNER A PORTION OF THE COST OF SEALANT
APPLICATION WHICH THE OWNER WOULD BE
RESPONSIBLE FOR HAVING APPLIED. WITHOUT
A NEGOTIATED SETTLEMENT THIS WILL BE A
CIVIL DISPUTE THAT THE BUILDING
DEPARTMENT WOULD HAVE NO JURISDICTION
OVER DUE TO MY DETERMINATION THAT AREAS
IN DISPUTE ARE NOT STRUCTURAL CONCERNS.
