SUBMITTED WHICH SHOWS THE FENCE
ENCROACHING 5 FT. INTO THE NEIGHBORING
PARCEL, I REALIZED THE SHAPE OF THE
PROPERTY DOES NOT MATCH THE SHAPE THAT
IS SHOWN ON THE PROPERTY APPRAISER'S
WEBSITE. I LOOKED AT THE DEEDS FOR BOTH
PARCELS (21 PEACEFUL PL - OR BK 2397 PG
146; 22 PEACEFUL PL - OR BK 2698 PG
1769) AND BOTH LEGAL DESCRIPTIONS
INCLUDE THE 5-FT STRIP OF LAND IN
QUESTION.
THERE WAS NO BUILDING PERMIT PULLED OR
ISSUED FOR THE FENCE, WHICH WAS
INSTALLED APPROXIMATELY TWO MONTHS AGO,
PURSUANT TO THE COMPLAINANT (I COULD NOT
LOCATE A PERMIT UPON LOOKING). IF THE
OWNER OF 21 PEACEFUL PL CAME IN TODAY TO
GET A PERMIT TO SOLVE THE NO-PERMIT
ISSUE, WE WOULD NOT BE ABLE TO SIGN OFF
ON THE CURRENT PLACEMENT SINCE WE NOW
HAVE KNOWLEDGE OF THE DISCREPANCY IN
LEGAL DESCRIPTIONS. HOWEVER, WE ALSO
CAN'T ENFORCE A SETBACK VIOLATION IF THE
FENCE IS LOCATED ON THE PROPERTY LINE
ACCORDING TO THE LEGAL DESCRIPTION ON
THE DEED.
I SPOKE WITH ENGINEERING DEPT FOR
GUIDANCE ON HOW FAR BACK A FENCE WOULD
NEED TO BE FROM THE INTERIOR ROADWAY, TO
WHICH THEY REPLIED THE MINIMUM
REQUIREMENT WOULD BE 6 FEET FOR
CLEARANCE AND VISIBILITY.
AT MINIMUM, CE WILL GO OUT TO THE
PROPERTY AND LET THE HOMEOWNER KNOW THAT
THE FENCE MUST MEET A 6 FT SETBACK FROM
THE EDGE OF THE ROADWAY ON THE NORTH
SIDE, AND MUST BE REMOVED FROM THE SOUTH
SIDE OF THE ROAD ALTOGETHER, AS THEIR
DEED STATES THIS AREA IS A COMMON
NON-EXCLUSIVE EASEMENT.
