PAINTING. DAVID BECAME INVOLVED WITH
THIS PROJECT TO REPAINT INTERIOR OF
HOME. HE STATED THAT THE PAINT WORK WAS
COMPLETED BUT QUALITY OF WORK WAS NOT
ACCEPTABLE TO OWNER. HE ALSO BECAME
INVOLVED IN SUPPLYING CONTACTS FOR MRS.
BAKER FOR OTHER WORK SHE WANTED
COMPLETED. HE DID NOT ACT AS CONTRACTOR
AND MONEY FOR THIS OTHER WORK WAS PAID
DIRECTLY TO OTHER CONTRACTORS. OTHER
WORK INCLUDED, TRIM WORK BY BEN DANLEY
OF HIGHLANDS CARPENTRY, GLOVER PLUMBING
TO REPLACED FIXTURES AND JOE MESSANNA
FOR SOME MINOR FRAMING REPAIR. WHEN I
ASKED WHO MIGHT HAVE INSTALLED THE NEW
CABINETS DAVID SAID BEN AND JOE MAY HAVE
BUT HE COULD NOT SAY FOR SURE. WHEN
ASKED WHO MIGHT HAVE INSTALLED THE NEW
WINDOWS HE SAID THE NEW WINDOWS WERE
INSTALLED WHEN HE MADE FIRST VISIT SO HE
DID NOT KNOW. I ASKED IF JIMMY PRICHETT
HAD DONE WORK ON THIS JOB AND HE SAID HE
DID NOT SEE HIM THERE BUT MRS. BAKER HAD
SAID HE WAS DOING SOME WORK FOR HER. I
WILL CONTACT JIMMY PRICHETT TO INQUIRE
EXTENT OF WORK HE PERFORMED.

WHO WAS THE FOREMAN ON THIS PROJECT.
THEY PRESENTED A COPY OF THE INVOICE FOR
THIS PROJECT DATED 12/7/2016. INVOICE
LISTS TILE WORK, DRYWALL WORK, REPLCING
HARDI PANEL AND PAINTING. INVOICE IS FOR
$10,000.00 AND SHOWS A $5,000.00 DEPOSIT
AND BALANCE OF $5,000.00. THEY ALSO
PRESENTED AN INVOICE FOR REFINISHING
TERAZZO FLOOR FOR $5,130.00 DATED
1/6/2017. THEY STATED THAT THIS BILL WAS
DISPUTED AND NEVER PAID. ATTEMPTED
REFINISH OF TERAZZO FLOOR WAS
UNACCEPTABLE TO CUSTOMER AND PURSUIT FOR
PAYMENT WAS NEVER INITIATED. I ASKED IF
THEY HAD REPLACED THE WINDOWS AS MRS.
BAKER CLAIMED, THEYSAID THAT THE
HARDI-PANEL WORK WAS ON THE FRONT AND
BATHROOM BAY WINDOW AREAS AND THAT THEY
HAD TO REMOVE THOSE WINDOWS TO REPLACE
THE SIDING AND THAT SHE HAD NEW WINDOWS
ONSITE AND THAT THEY HAD INSTALLED A NEW
WINDOW IN THE FRONT BAY WINDOW WHEN
REPLACING BUT THE OLD WINDOW WAS
REINSTALLED IN THE BATHROOM. I ASKED IF
THEY HAD DEMOED THE BATHROOM AS MRS.
BAKER CLAIMED. THEY SAID THAT WHEN THEY
SHOWED UP TO START THE PAINTING THE
KITCHEN CABINETS AND THE BATHROOM SINK
HAD BEEN REMOVED AND WHERE SITTING ON
THE FLOOR AND THAT THEY HAD MOVED THEM
TO THE FRONT YARD SO THEY COULD WORK. I
ASKED IF THEY KNEW WHO HAD REMOVED THE
CABINETS AND THEY BELIEVED THE SOMEONE
NAMED JIMMY WAS ONSITE AND THAT HE HAD
POSSIBLY REMOVED THE CABINETS. I SHARED
THAT MRS, BAKER HAD SAID THAT A JIMMY
PRITCHETT HAD DONE THE SCREENROOM AND
PATIO ON THE BACK AND THEY SAID THEY
THOUGHT THAT THIS WAS PROBABLY THE SAME
GENTLEMAN AND THAT HE HAD INSTALLED
METAL ROOFING ON THE BACK PORCH AREA OF
THE HOME. I ASKED IF THEY HAD ENLISTED
ANY OTHER SUB-CONTRACTORS TO PERFORM
WORK AT THIS SITE AND THEY SAID NO BUT
THEY KNEW MRS. BAKER HAD AARON HURETT
WORKING ON THE ELECTRIC ADDING AN OUTLET
FOR HER MOBILE HOME. I ASKED IF THEY
KNEW OF A DAVID LUSBY AND THEY SAID THEY
BELIEVED HE WAS A PAINTER WITH COMPANY
NAME OF PRECISE PAINTING. AFTER MEETING
I LOOKED UP PRECISE PAINTING WHICH HAS
LYLE WILSON AS QUALIFIER. I CALLED LYLE
AND GOT A PHONE NUMBER FOR DAVID LUSBY
633-9042. I ASKED LYLE IF HE KNEW OF A
JIMMY PRITCHETT AND HE SAID HE BELIEVED
HE WAS POSSIBLY WORKING UNDER A NATHAN
BREWER. I LOOKED UP NATHAN BREWER AND HE
IS A CERTIFIED CLASS B CONTRACTOR AND
QUALIFIES TCR ENTERPRISES, 441-1090. I
WILL CALL DAVID LUSBY AND NATHAN BREWER
NEXT WEEK TO FURTHER INQUIRE ABOUT WORK
AT THIS PROJECT.
07-12-201709:28 AMINITIAL INSPECTIONMADE SITE VISIT AND SPOKE WITH MRS.
BAKER ABOUT HER COMPLAINT. HER INITIAL
RESPONSE WAS "WHUCH ONE?" THROUGH
CONVERSATION SHE REVEALED THAT SHE HIRED
AN ATTORNEY TO FILE THIS COMPLAINT
AGAINST OTG CONSTRUCTION AND THAT SHE
WAS FILING CRIMINAL CHARGES AGAINST
ANOTHER INDIVIDUAL WHO HAD DONE WORK AT
HER HOME. DIRECTING CONVERSATION BACK TO
HER COMPLAINT AGAINST OTG I ASKED WHAT
WORK THEY HAD PERFORMED. SHE SAID THEY
HAD PAINTED, REMOVED VANITY AND SINK IN
A BATHROOM, REPLACED WINDOWS AND
ATTEMPTED REPAIR OF TERAZZO FLOOR. WHEN
I ASKED IF THEY HAD REPLACED THE VANITY
AND SINK SHE SAID SOMEONE ELSE HAD
REPLACED THEM. HER COMPLAINT WAS THAT
THE PAINT HAD TO BE REDONE BECAUSE
INEXPERIENCED HELPERS HAD DONE THE WORK
AND THAT THE FLOOR REPAIR WAS
UNACCEPTABLE ALTHOUGH SHE DIVULDGED THAT
SHE HAD NOT PAID FOR THE ATTEMPTED
REPAIR WORK. SHE SAID THAT A DAVID LUSBY
WAS HIRED TO REPAINT. SHE WAS UNSURE OF
THE SPELLING OF HIS NAME AND WE HAVE NO
RECORD OF A DAVID LUSBY LICENSED IN THIS
COUNTY. WHEN ASKED WHO REPLACED THE
BATHROOM VANITY SHE SAID JOE MESSANA HAD
REPLACED THE VANITY AND INSTALLED NEW
KITCHEN CABINETS. I ASKED IF SHE HAD
CONTACTED MR. MESSANA SHE SAID MR, LUSBY
HAD CONTACTED MR. MESSANA IN HER BEHALF.
SHE WAS NOT HAPPY WITH MR. MESSANA'S
WORK EITHER. SHE THEN OFFERED THAT A
JIMMY PRITCHETT HAD INSTALLED AN
ALUMINUM SCREENROOM AND PAN ROOF SYSTEM
AND AN ALUMINUM PAN ROOF SYSTEM OVER A
REAR PATIO AND THAT THIS WORK WAS NOT
DONE CORRECTLY EITHER. AGAIN WE HAVE NO
JIMMY PRITCHETT LICENSED IN OUR COUNTY.
SHE ALSO SAID MR. PRITCHETT HAD
INSTALLED A METAL ROOF ON THE REAR PORCH
FLAT ROOF AREA SOME TIME AGO WHEN SHE
FIRST PURCHASED THIS HOME. MR. PRITCHETT
IS THE INDIVIDUAL THAT SHE IS FILING
CRIMINAL CHARGES AGAINST. SHE SAYS THAT
SHE WAS OVER CHARGED FOR MATERIALS THAT
SHE HAD PAID FOR. MRS. BAKER EXPRESSED
IN EVERY CASE THAT SHE HAD QUESTIONED IF
PERMITTING WAS REQUIRED AND ALL INVOLVED
ALWAYS SAID NONE WAS NEEDED. I HAVE BEEN
TO THIS ADDRESS IN DECEMBER ON A CALL OF
UNLICENSED CONTRACTOR DOING ELECTRICAL
WORK. AARON HURRET WAS FOUND WORKING ON
REPLACING THE ELECTRIC PANEL. AARON HAS
BEEN APPROVED TO TAKE THE ELECTRICAL
EXAM FOR LICENSURE BUT HAD NOT PASSED
THE EXAM. HE WAS ISSUED A CITATION FOR
UNLICENSED ACTIVITY. MRS. BAKER HAD
APPARENTLY HIRED HIM TO REPLACE THE
PANEL. A LICENSED CONTRACTOR OBTAINED A
PERMIT IN JANUARY AND COMPLETED THE
WORK. MRS. BAKER ALSO OBTAINED A
HOMEOWNER PERMIT FOR THE FENCE IN
NOVEMBER BUT NEVER CALLED FOR
INSPECTION. A LICENSED MECHANICAL
CONTRACTOR ALSO OBTAINED A PERMIT TO
REPLACE THE A/C SYSTEM IN DECEMBER BUT
INSPECTION WAS NEVER REQUESTED FOR THAT
PROJECT EITHER. WHEN THERE IN DECEMBER I
NOTICED THAT PAINTING WAS BEING DONE AND
WHEN ELECTRICAL INSPECTION WAS PERFORMED
ON FEBRUARY 13 HOME APPEARED READY FOR
HABITATION. ALUMINUM SCREENROOM AND
PATIO ROOF WAS NOT PRESENT WHEN THIS
INSPECTION WAS PERFORMED. I CALLED
DARRYL KINCHEN OF OTG CONSTRUCTION TO
GARNER EXTENT OF SCOPE OF HIS WORK.
