PHONE CONTACT WITH MR. ROSE AND MET HIM
ONSITE TO INSPECT THIS PROJECT. CONTRACT
WAS TO TEAR OUT AND REPLACE SEAWALL AND
DECK. MR. ROSE SAYS THAT EXISTING
SEAWALL WAS NOT REMOVED AND NEW SEAWALL
WAS CONSTRUCTED IN FRONT OF EXISTING.
THIS CAUSED THE WALKWAY DECK TO BE
NARROWER THAN THE ORIGINAL 5' DECK. MR.
ROSE PROVIDED PHOTOS OF EXCAVATION
INVESTIGATION SHOWING ORIGINAL SEAWALL
ENCLOSED BY NEW CONSTRUCTION. MR. ROSE
ALSO QUESTIONED CONSTRUCTION AS FILL
BEHIND SEAWALL HAD LARGE DEPRESSION.
THIS DEPRESSION IS WHERE SEAWALL BORDERS
A LARGE TREE AND THE DEPRESSION IS
FILLED WITH LEAVES FROM THE TREE. I
COULD NOT SEE WHERE THE FILL HAS WASHED
INTO THE CANAL AND I WOULD CONCLUDE THAT
THE DEPRESSION IS FROM SETTLEMENT OF THE
FILL AND ORGANIC MATERIAL COLLECTING AT
SEAWALL AND NOT DUE TO SEAWALL FAILURE.
I ASKED MR. ROSE WHAT HE WISHED TO
RESOLVE AND HE STATED THAT HE WAS
UNHAPPY WITH THE NARROW DECK/WALKWAY AT
BOATHOUSE. THIS DECK/WALKWAY IS
COMPLIANT BUT IS NARROWER THAN ORIGINAL.
I HAVE SINCE MADE SEVERAL ATTEMPTS TO
HAVE CONTRACTOR MEET WITH OWNER TO
NEGOTIATE RESOLUTION. THIS HAS NOT
HAPPENED DUE TO HURICANE ACTIVITY AND
THE FACT THAT OWNER IS LIVING OUT OF
TOWN. I DO QUESTION WHY PROPOSAL DOES
NOT HAVE A DATE,LICENSE NUMBER OR
SIGNATURE OF ACCEPTANCE BY OWNER AND
ALSO QUESTION WHY COMPLAINT WAS FILED IN
JUNE OF 2017 WHEN COPIES OF PAYMENT
CHECKS SHOW WORK WAS INITIATED IN AUGUST
OF 2015 AND COMPLETED IN OCTOBER OF
2015. WHILE PERMIT WAS NOT OBTAINED FOR
THIS PROJECT CONSTRUCTION APPEARS TO BE
CODE COMPLIANT AND COMPLAINT IS 2 YEARS
AFTER THE FACT. MEDIATION EFFORTS HAVE
BEEN UNSUCCESSFUL. BUILDING OFFICIAL HAS
NO RECOMMENDATION FOR THIS CASE WILL
PRESENT TO BOARD FOR THEIR ACTION.
