BEEN RETAINED BY THE NEIGHBOR/ I DID
SOME RESEARCH AND THE SPOKE TO LINDA WHO
HAD A MEETING WITH ERIC, BEN AND
HHERSELF AND THEY DECIDED IT WAS A CIVIL
MATTER/ I ALSO SPOKE TO HEIDI WHO STATED
A LETTER IS GOING OUT SOON AND THEY WILL
HAVE TO OBTAIN A WAIVER FROM THE
NEIGHBOR OR MODIFY THE TERMINAL PLATFORM
TO WHAT IT WAS PRIOR TO THE REGULATIONS
OR REMOVE THE DOCCK AND OBTAIN PROPER
SETBACKS ALONG WITH PERMITTING /HEIDI
ALSO STATED THAT WHEN REDECKING YOU ARE
ALLOWED TO REPLACE STRINGERS AND THAT IS
CONSIDERED PART OF THE DECKING AND THAT
IS WHAT THE PERSON HAS DONE AT THIS

04-25-201710:21 AMINITIAL INSPECTIONTHIS IS AN ONGOING COMPLAINT. ON JUNE
22, 2016 WE RECEIVED A CALL THAT A DOCK
WAS BEING BUILT WITHOUT PERMITTING.
CE16060096 WAS CREATED. JEFF BROCK MADE
A SITE VISIT AND LEFT A STOP WORK ORDER
WITH NOTED QUESTION IF THIS WAS A NEW OR
EXISTING DOCK THAT WAS HAVING THE
DECKING REPLACED. IT WAS DETERMINED AT
THAT TIME THAT THIS WAS AN EXISTING DOCK
THAT WAS BEING REDECKED WHICH DOES NOT
REQUIRE PERMITTING OR INSPECTION. ON
AUGUST 10,2016 ROBERT SBZOKA, WORKING AS
A TEMPORARY EMPLOYEE, FOLLOWED UP ON A
CALL CONCERNING THIS DOCK AND LEFT A TAG
TO CONTACT THE BUILDING DEPARTMENT ABOUT
PERMITTING ALLEDGED CHANGE TO DECKING.
ON AUGUST 22,2016 THE OWNER CALLED AND
STATED THAT DOCK HAD BEEN DEDECKED AND
CASE WAS CLOSED. AT SOME DATE AFTER THIS
I MADE A SITE VISIT TO INVESTIGATE AFTER
ANOTHER CALL AND SPOKE WITH NEIGHBOR
ABOUT CONCERNS. NEIGHBOR ADMITTED THAT
DOCK AND DECK HAD BEEN IN EXISTANCE FOR
EXTENDED TIME. WHEN I INFORMED THAT
EXTENT OF WORK DONE ON EXISTING DOCK DID
NOT REQUIRE PERMITTING OR INSPECTION
NEIGHBOR CLAIMED THAT PILINGS AND SUPORT
STRUCTURE HAD BEEN REPLACED. I OBSERVED
ONE STRINGER THAT HAD BEEN REPLACED NEAR
THE LANDWARD END OF THE DECK WHICH STILL
WOULD NOT CONSTITUTE PERMITING. IT
BECAME OBVIOUS TO ME THAT NEIGHBOR WAS
HOPING TO CREATE OPPORTUNITY TO FORCE
REMOVAL OF ENTIRE DOCK. NEIGHBOR
PRODUCED A SURVEY OF THEIR PROPERTY THAT
SHOWED DECK ON LAND HAD A CORNER
ENCROACHING 30" ONTO THEIR PROPERTY.
DOCK APPEARS ON THE PROPERTY APPRAISERS
SITE IN 1990 SO IT HAS BEEN IN EXISTANCE
FOR 27 YEARS. WHETHER IT WAS PROPERLY
PERMITTED AT THAT TIME IS NOT KNOWN AS
RECORDS HAVE BEEN PURGED. RECORDS MUST
BE KEPT FOR 10 YEARS. AS FAR AS THE
BUILDING DEPARTMENT IS CONCERNED, THE
WORK COMPLETED ON THE EXISTING DOCK DOES
NOT REQUIRE PERMITTING OR INSPECTION.
THE OLD DOCK WAS NOT TAKEN DOWN AND
RECONSTRUCTED AT TIME OF INSPECTION. NEW
POSTS AND STRINGERS WERE NOT PRESENT
EXCEPT FOR THE ONE NOTED AT LANDWARD END
OF DECK. DECKING ALONG THE LAND PORTION
OF THE DOCK DOES ENCROACH ONTO NEIGHBORS
PROPERTY AND DOCK DOES NOT APPEAR TO
MEET CURRENT SETBACK REGULATIONS.
