NOT DO ANYTHING WRONG. ZONING DEPT.
ASSISTED W/ THE COUNTER PRINTING THE TWO
SPECIAL EXECPTIONS, AND WE ALL DISCUSSED
(GIVING THEM A COPY OF THE S.E. AND THE
AU ZONING DISTRICT) THE INFORMATION
GIVEN, CLEARLY HIGHLIGHTING WHAT THEY
CAN AND CANNOT DO W/ THE S.E. THE
AUCTIONEER WAS VERY INTERESTED IN
RE-APPLYING FOR A NEW S.E. TO ALLOW THEM
TO SELL MERCHANDISE, RELATED TO AG. HE
FIRST INQUIRED IF THEY COULD ALLOW FOR
INDIVIDUALS TO SET UP TABLES TO DO LIKE
A FLEA MARKET SETTING, WE INFORMED HIM
THAT NO THIS WAS NOT PERMITTED IN AU. JS
FROM ZONING INFORMED HIM OF THE FEES FOR
THE S.E. AND THE MAILING, ETC. SHE ALSO
INFORMED HIM THAT SHE WOULD HAVE TO
REVIEW HIS REQUEST W/ LC. ZONING SUPER.
TO SEE IF STAFF WOULD RECOMMEND
APPROVAL. WE DID EXPLAIN TO HIM THAT IF
STAFF SAID THEY DID NOT THINK IT WOULD
BE APPROVED, THAT IF HE DECIDED TO MOVE
FORWARD, THAT HE WOULD LOSE HIS MONEY IF
IT WAS NOT APPROVED BY THE BOA. THEY
TOOK THE PAPER WORK FOR THE S.E., AND
ALSO TOOK THE INFORMATION THAT WE
PROVIDED TO THEM. JS W/ ZONING TOOK A
LIST OF ITEMS THAT THEY WOULD LIKE TO
SELL TO REVIEW W/ L.C. ZONINNG SUPER.
GAVE THEM HO CARD AS WELL AS JD CARD IF
THEY HAD ANY FURTHER QUESTIONS. THEY ALL
SHOOK MY HAND, AND THANKED US ALL OF OUR
TIME. D.R. DID SOME TRANSLATING FOR CE
AT THE COUTER WHICH HELPED.

HIGHLANDS COUNTY LAND DEVELOPMENT
REGULATIONS, DIVISION 2. DISTRICT
REGULATIONS, SECTION 12.05.200 AU
AGRICULTURAL DISTRICT - SPECIFICALLY
PROHIBITS AGRICULTURAL ZONED DISTRICTS
FROM CONDUCTING ANY BUSINESS ESTABLISHED
FOR DISPLAY, STORAGE, OR SALE OF USED OR
SECONDHAND MERCHANDISE OR BUILDING
SUPPLIES OR MATERIAL DISPLAY, STORAGE OR
SALE, EXCEPT FOR STORAGE OF BUILDING
MATERIALS INCIDENTAL TO AGRICULTURE.

YOUR REQUEST AND SUBSEQUENT APPROVAL OF

AND WE ADVISED OUR PURPOSE VIA A
TRANSLATOR (STATE AG EMPLOYEE) THE
AUCTIONEER ADVISED THAT HE LEASED THE
SITE FROM THE OPWNERS AND WAS ADVISED
THAT HE COULD SELL ANYTHING THAT WAS AG
RELATED I ADVISED THAT THE SPECIAL
EXCEPTION AND AG RULES PROHIBIT THE SALE
OF GEBERAL MERCHANDISE OR BUILDING
MATERIALS HE UNDERSTOOD OUR PURPOSES BUT
WAS UPSET AT THE OWNER FOR GIVING HIM
FALSE INFORMATION AS HE HAS INVESTED HIS
TIME AND ENGTRY INTO THE AUCTION HE
CALLED THE OWNER AND GAVE ME THE PHONE
THE OWNER ACKNOWLEDGED THE RESTRICTIONS
AND FELT THE THE AUCTIONEER WWAS
PROPERLY NOTIFIED OF HE RESTRICTIONS THE
OWNER ALSO QUESTIONED THE RESTRICTIONS
AS HE WAS TOLD BY THE "COURTS" THAT HE
COULD SELL GENERLA MERCHANDISE RELATED
TO AG USAGE I ADVISED THE WE HAVE
OBSERVED TILE, TOOLS, GENERATORS AND
THATR WE WOULD BE MAILING HIM A KETTER
NEXT WEEK TO ADVISE AND REMIND HIM OF
THE RESTRICTIONS. HE QUESTIONED WHY THE
HARM AS THE AUCTION WAS GEARED TOWARD

ANIMALS. ITEMS INCLUDE IN PAST PRESSURE
WASHERS, FURNITURE, CAGES, ALMOST
ANYTHING THAT PEOPLE BRING TO THE SITE.
ALSO PARTIES INDICATE THAT THE GENERAL
MERCHANDISE VENDO HAVE NOT BEEN PRESENT

SPECIAL EXCEPTION. APRIL AND I MET WITH
STAFF AND IT WAS DETERMINED THAT A SITE
VISIT WAS REQUIRED TO DETERMINE WHAT WAS
ACTUALLY OCCURING. ON SATURDAY MAY 21 WE
VISITED THE AUCTION LOCATION AND
OBSERVED ONE VENDOR SELLING FROM HIS
EHICLE AND A TABLE NEW AND USED GENERAL
MERCHANDISE. WE ALSO OBSERVED TWO
VEHICLES IN THE AUCTION ARENA WITH FOR
SALE SIGNS. THE ANIMAL AUCTION BEGAIN AT
7 PM AS REQUIRED AND HE WAS SELLING
ANIMALS, EGGS AND AN INCUBATOR, THE
AUCTIONEER DID ANNOUNCE THAT THERE WOULD
BE NO SALES OF GENERALL MERCHANDISE IN
THE FUTURE UNTILL OTHERWISE ADVISED AND
HE DID ANNOUNCE A RAFFEL FOR ONE OF THE
TWO VEHICLES FOR SALE ON THE PROPERTY
WITH TICKETS AT $25.00 EACH AH AND HO
