COMPLIANCE WE ALSO ADVISED THAT IF THE
PROPERTYU IS NOT BROUGHT INTO COMPLIANCE
WE WILL ASK THE SPECIAL MAGISTRATE FOR
REMOVAL AND ISSUE A LIEN. WE ALSO
DISCUSSDED THE POSSIBILITY OF FENCING
THE SEAWALL OFF WITH BARBED WIRE WE

PHILLIPS. HE HAD CALLED AND REQUESTED A
MEETING TO DISCUSS OPTIONS FOR
COMPLIANCE. 860-753-0333. TOLD HIM
THAT MY NUMBER 1 CONCERN WAS THE SAFETY
ISSUE WITH THE COLLAPSED SEAWALL AND
THAT MY SECONDARY CONCERN WAS THE
REPLACEMENT OF THE FAILED STRUCTURE. A
VIOLATION NOTICE HAS BEEN ISSUED
REQUIRING COMPLIANCE BY APRIL 20TH AND
MR. PHILLIPS WANTED TO DISCUSS OPTIONS
TO REPLACING THE ENTIRE SEAWALL. I TOLD
HIM THAT PARTIAL REPLACEMENT WAS NOT AN
OPTION SINCE THE REMAINING STRUCTURE HAS
PROVEN TO BE DEFICIENT. HE EXPRESSED
THAT HE WOULD LIKE TO PROVIDE THE NEW
BUYER THE OPTION OF BUILDING A NEW
STRUCTURE TO THEIR SPECIFICATIONS.
AFTER FURTHER DISCUSSION I EXPRESSED
THAT TO MEET THE CURRENT VIOLATION I
WOULD ACCEPT A BARRIER TO KEEP THE
PUBLIC AWAY FROM THE HAZARD AS A
TEMPORARY SOLUTION. FURTHER DISCUSSION
ABOUT TYPE OF BARRIER THAT WOULD SUFFICE
CONCLUDED THAT I WOULD ACCEPT A FIVE
STRAND BARBED WIRE BARRIER AROUND THE
SEAWALL BUT THAT THIS WOULD NOT REMOVE
THE VIOLATION NOTICE REQUIRING REMOVAL
AND REPLACEMENT OF SEAWALL. I WILL
ACCEPT THE DESCRIBED BARRIER AS A
TEMPORARY SOLUTION AND EXTEND THE
VIOLATION NOTICE TO BE REMEDIATED WITHIN
ONE YEAR.

ALLOWING THE EARTHEN BACKFILL TO SETTLE
INTO THE CANAL. THE CONCRETE CAP HAS
ALSO FAILED STRUCTURALLY. DEMOLITION OF
THE EXISTING SEAWALL AND REPLACEMENT
WILL BE REQUIRED AND ASBESTOS
REMEDIATION IF THIS IS ACTUALLY ASBESTOS
PANEL CONSTRUCTION.
