NOW DUE TO WATER LEAKS. THE FRONT PROCH
FLOOR AND WALLS ARE VERY UNSTABLE DUE TO
ROTTEN WOOD STUDS AND FLOOR JOISTS. THE
FLOOR INSIDE THE HOME IS VERY UNEVEN DUE
TO WEAK FLOOR JOISTS AND PIERS THAT
OFFER SUPPORT BUT THE WEAK JOISTS SAG
AND BOW ONCE THEY ARE NO LONGER
SUPPORTED BY THE PIER. THE SIDING IS IN
VERY POOR CONDITION AND HAS HOLES AND
SPLITS IN IT THAT ALLOW WATER TO ENTER
THE WALL AND ROT THE STUDS AND BOTTOM
WALL PLATE. THE WINDOW FRAMES HAVE
HOLES AROUND THEM THAT ALLOW WATER TO
ENTER THERE ALSO. DUE TO THE CONTINUING
DETERIOATING CONDITION OF THE HOME, WITH
NO ATTEMPTS AT MAKING REPAIRS, I

APRIL HARTSEIL. TESTIMONY WAS HEARD
FROM HIGHLANDS COUNTY BUILDING OFFICIAL
SOL MOSELEY, BRENDA DORSEY KERNEY, AND
APRIL HARTSEIL. THE SPECIAL MAGISTRATE
FOUND THAT PROPER NOTICE OF THE
VIOLATIONS HAD BEEN PROVIDED TO THE
RESPONDENTS, THAT THE RESPONDENTS HAD
BEEN GIVEN A REASONABLE TIME TO CORRECT
THE VIOLATIONS, THAT THE VIOLATIONS
CONTINUED BEYOND THE TIME SPECIFIED FOR
CORRECTION, AND THAT PROPER NOTICE OF
THE HEARING WAS PROVIDED TO THE
RESPONDENTS. FOLLOWING PETITIONER?S
REQUEST, THE SPECIAL MAGISTRATE ORDERED
THE RESPONDENTS TO BRING PROOF OF
COMPLIANCE TO THE HIGHLANDS COUNTY CODE
ENFORCEMENT DEPARTMENT ON OR BEFORE
SEPTEMBER 1, 2011, AND RESPONDENTS TO
COOPERATE WITH QUARTERLY INSPECTIONS ON
OR ABOUT DECEMBER 1, 2010, MARCH 1,
2011, AND JUNE 1, 2011, TO BE CONDUCTED
BY HIGHLANDS COUNTY BUILDING INSPECTORS

PETITIONER?S REQUEST, THE SPECIAL
MAGISTRATE ORDERED THE RESPONDENTS PAY
TO THE PETITIONER A FINE OF $100.00, THE
INVESTIGATION COST OF $35.18, THE
PROSECUTION COST OF $243.88, THE
RECORDING COSTS OF $28.50, AND THE
ADMINISTRATIVE HEARING FEE OF $125.00.
THE TOTAL LIEN AMOUNT OWED BY THE

THIS IS AN OLDER WOOD FRAME HOME IN FAIR
CONDITION. THERE ARE SEVERAL PLACES ON
THE EXTERIOR WALLS WHERE THE SIDING IS
ROTTED LEAVING HOLES AND GAPS IN THE
WALLS. THIS ALLOWS RAIN TO ENTER THE
WALL AND CUASE MORE DAMAGE TO THE FLOOR
SYSTEM. THE ROOF ALSO HAS SEVERAL AREAS
OF ROTTEN WOOD IN THE EAVES AND AT THE
OVERHANG. THESE AREAS NEED REPAIR TO
PREVENT THE METAL TIN ROOF FROM BEING
BLOWN OFF. ONCE THE SIDING IS REPAIRED
ALL THE EXTERIOR WALLS NEED TO BE
CLEANED AND PAINTED TO PREVENT FURTHER
DAMAGE TO THE BUILDING.
