RECEIVED SEVERAL CALLS REGARDING THIS PROPERTY
TODAY, TWO CALLS FROM NEIGHBORS AND ONE FROM
SEBRING CODE ENFORCEMENT. THIS IS AN ABANDONED
TRAILER THAT IS IN VERY POOR CONDITION, THERE IS
AT LEAST ONE HOMELESS PERSON THAT MAY BE STAYING
IN THE TRAILER AT NIGHT. ALL OF THE CALLERS STATED
THAT KIDS FROM THE HIGH SCHOOL PLAY HOOKY AND STAY
IN THE TRAILER, THE NEIGHBORS FEEL THAT THIS IS A
SERIOUS HEALTH AND SAFETY ISSUE. JOE

AND ADDITIONS THAT WERE ADDED TO THE
HOME. SINCE THE FIRST INSPECTION IN
JANUARY THE ADDITIONS HAVE CONTINUED TO
DETERIOATE. THE ROOF RAFTERS CONTINUE
TO SAG, DUE TO NOT BEING THE CORRECT
SIZE FOR THE SPAN AND THE ROOF HOLDS
WATER IN THE LOW SPOTS WHEN IT RAINS.
THIS WATER IS NOW SEEPING THROUGH THE
ROOF AND WETTING THE SHEATHING AND
RAFTERS. THESE MEMBERS WILL SOON BEGIN
TO ROT AND COLLAPSE WHEN WEAKEND. THE
MOBILE HOME HAS SEVERAL LEAKS IN IT AS
WELL. THE EAST AND WST ENDS OF THE UNIT
HAVE BROKEN OR MISSING WINDOWS THAT ARE
ALLOWING WATER TO ENTER THE WALL AND ROT
IT OUT. THIS IS ALSO SPREADING OUT INTO
THE FLOOR AREA. WHERE THE ADDITION WAS
ADDED TO THE SIDE OF THE HOME AT THE
S.W. CORNER, A LARGE SECTION OF THE
MOBILE HOME WALL WAS REMOVED. THIS HAS
WEAKENED THE EXTERIOR WALL AND CAUSED A
HAZARDOUS CONDITION TO EXIST DUE TO THE
LACK OF SUPPORT FOR THE ROOF. DUE TO
THE CONTINUING DETERIOATING CONDITION OF
THE MOBILE HOME WITH NO ATTEMPT AT
REPAIRS AND THE UNSAFE CONSTRUCTION OF
THE ROOM ADDITIONS, I AM RECOMMENDING
REMOVAL OF THE ADDITIONS AND THE MOBILE
HOME.

WITNESS FOR THE PETITIONER, HIGHLANDS
COUNTY BUILDING OFFICIAL SOL Y. MOSELEY
TESTIFIED HE PERFORMED AN INSPECTION ON
A MOBILE HOME WITH SITE BUILT ADDITIONS
ON BOTH SIDES OF THE MOBILE HOME, AND A
DETACHED ACCESSORY STRUCTURE. MR.
MOSELEY WENT ON TO TESTIFY THAT THE
ADDITIONS WERE NOT BUILT TO CODE, AND HE
FOUND NO PROOF THAT ANY PERMITS HAD BEEN
PULLED FOR THE CONSTRUCTION OF THE
ADDITIONS. THE DETACHED ACCESSORY
STRUCTURE AT THE REAR OF THE PROPERTY IS
A CONCRETE BLOCK CARPORT THAT HAD BEEN
DIVIDED INTO SEVERAL INDIVIDUAL SLEEPING
QUARTERS THAT DID NOT MEET BUILDING
CODE, THERE WAS NO PROOF THAT BUILDING
PERMITS HAD BEEN PULLED FOR THE
CONSTRUCTION OF THE INDIVIDUAL SLEEPING
QUARTERS. MR. MOSELEY RECOMMENDED THE
DETACHED ACCESSORY STRUCTURE BE REMOVED
FROM THE PROPERTY. MR. MOSELEY TESTIFIED
THAT IT WOULD NOT BE POSSIBLE TO REMOVE
THE ADDITIONS WITHOUT CAUSING
SIGNIFICANT DAMAGE TO THE MOBILE HOME,
SO HE DID NOT RECOMMEND REMOVING THE
ADDITIONS AT THIS TIME. CODE ENFORCEMENT
OFFICER APRIL HARTSEIL STATED THAT THIS
PROPERTY ABUTS SEBRING HIGH SCHOOL; ALL
OF THE STRUCTURES ARE UNSECURED AND HAVE
BECOME A HANG OUT FOR STUDENTS SKIPPING
SCHOOL. MS. HARTSEIL TESTIFIED THAT A
VIOLATION OF COUNTY CODE SECTION
12.16.300 (NUISANCE UNSAFE STRUCTURE)
WAS OBSERVED ON THE PROPERTY. MS.
HARTSEIL WENT ON TO TESTIFY THAT NOTICE
OF VIOLATION #411 WAS ISSUED ON MARCH 9,
2009, THE RESPONDENT WAS GIVEN A
REASONABLE PERIOD OF TIME TO CORRECT THE
VIOLATION, THE VIOLATION CONTINUED
BEYOND THE DATE SPECIFIED FOR
CORRECTION, AND THE VIOLATION HAD NOT
BEEN CORRECTED AS OF THE DATE OF THE
HEARING. THE CASE WAS SCHEDULED FOR A
PUBLIC HEARING, THE RESPONDENT AND ALL
INTERESTED PARTIES WERE PROPERLY
NOTIFIED OF THE HEARING. THE RESPONDENT
REQUESTED ADDITIONAL TIME TO BRING THE
PROPERTY INTO COMPLIANCE, AND A JOINT
CONTINUANCE WAS APPROVED. THE RESPONDENT
FAILED TO CORRECT THE VIOLATION IN THE
PERIOD OF TIME AGREED UPON IN THE JOINT
CONTINUANCE, AND THE VIOLATION HAD NOT
BEEN CORRECTED AS OF THE DATE OF THE
HEARING. THE PETITIONER REQUESTED TO BE
REIMBURSED FOR COSTS AND FEES ASSOCIATED
WITH THE CASE. THE SPECIAL MAGISTRATE
FOUND THAT A VIOLATION DID EXIST, THE
PROPERTY WAS NOT IN COMPLIANCE AT THE
TIME OF THE HEARING, AND PROPER
NOTIFICATION HAD BEEN GIVEN. THE SPECIAL
MAGISTRATE ADMITTED ALL EXHIBITS INTO
EVIDENCE. THE SPECIAL MAGISTRATE ORDERED
THE RESPONDENT TO PAY TO THE PETITIONER
A FINE OF $2,150.00, $150.00 COST OF A
TITLE SEARCH, $112.50 COST OF
INVESTIGATION, $125.00 ADMINISTRATIVE
