FOLLOWS;

1) THE RESPONDENT WAS ISSUED A REPEAT
VIOLATION, CITIATION NO. 005063, FOR
EXCESSIVE NOISE FROM BARKING DOGS
PURSUANT TO SECTION 5.6-105 OF THE
HIGHLANDS COUNTY CODE OF ORDINANCES.

2) THE RESPONDENT WAS PREVIOUSLY ISSUED
A CITATION ON APRIL 24, 2007 FOR
VIOLATION THE SAME CODE SECTION.
HOWEVER, AT THE HEARING RESULTING FROM
THAT CITATION, THE UNDERSIGNED
MAGISTRATEFOUND THERE WAS NO VIOLATION
AND THAT HIGHLANDS COUNTY CODE SECTION
5.6-107 (11) CREATED AN EXEMPTION FOR
BUSINESSES GRANTED A SPECIAL EXCEPTION.

3) THE RESPONDENT WAS NOT ORDERED TO PAY
A FINE, FEES OR COSTS OF SAID
ADMINISTRATIVE HEARING.

4) THE RESPONDENT TESTIFIED NO VIOLATION
HAD EVER BEEN FOUND WITH RESPECT TO THE
CITATIONS HE HAD PREVIOUSLY RECEIVED.

9) HIGHLANDS COUNTY CODE SECTION 2-333
DEFINES REPEAT VIOLAION AS A VIOLATION
OF A PROVISION OF COUNTY CODE BY A
PERSON WHO HAS PREVIOULSY, WITHIN TWO
YEARS PRIOR TO THE VIOLATION:

A. PAID A CIVIL PENALTY FOR A
VIOLATION OF THE SAME PROVISION, OR

B. BEEN FOUND BY THE CODE
ENFORCEMENT SPECIAL MAGISTRATE OR ANY
OTHER JUDICIAL PROCESS TO HAVE VIOLATED
OR WHO HAS ADMITTED VIOLATINGTHE SAME
PROVISION.

10) PRUSUANT TO COUNTY CODE SECTION
2-370, ENTITLED ISSUANCE AND ENFORCEMENT
OF CITATIONS, CODE ENFORCEMENT OFFICERS
SHALL PROVIDE WRITTEN WARNING NOTICE
PRIOR TO ISSUING A CITATION AND PROVIDE
THE PERSON THAT HAS COMMITTED A

ENFORCEMENT OFFICER BEVERLY SINGLEY AS A
WITNESS. MRS. SINGLEY WAS QUESTIONED IN
REGARDS TO HER INSPECTIONS IN WHICH SHE
USED A SOUND LEVEL METER TO MEASURE THE
AMOUNT OF NOISE COMING FROM THE DAWG
HOUSE KENNELS, THE RESPONDENT WAS GIVEN
AN OPPORTUNITY TO CROSS EXAMINE MRS.
SINGLEY. THE PETITIONER CALLED
ZONING/CODE ENFORCEMENT SUPERVISOR LINDA
CONRAD AS A WITNESS. MS. CONRAD WAS
QUESTIONED IN REGARDS TO THE SPECIAL
EXCEPTION THAT WAS GRANTED TO THE DAWG
HOUSE KENNELS IN 1990. THE PETITIONER
RESTED IT?S CASE, THE SPECIAL MAGISTRATE
REQUESTED A SHORT BREAK. UPON RETURNING
FROM THE BREAK, THE SPECIAL MAGISTRATE
STATED THAT SHE WAS READY TO MAKE HER
RULING ON THE CASE. THE SPECIAL
MAGISTRATE BEGAN BY STATING THAT IN HER
PREVIOUS ORDER OF JUNE 21, 2007 SHE
EXCEEDED HER RANGE OF AUTHORITY BY
ATTEMPTING TO SET SOUND CONTROL DECIBEL
LEVELS ON THE SPECIAL EXCEPTION, WHEN
DECIBEL LEVELS HAD NOT BEEN SET BY THE
BOARD OF ADJUSTMENTS WHEN THE SPECIAL
EXCEPTION WAS ISSUED. THE SPECIAL
MAGISTRATE FINDS THAT THE RESPONDENT IS
NOT IN VIOLATION OF COUNTY CODE 5.6-105
(D) BECAUSE THE RESPONDENT IN NEITHER
THE ?OWNER OR CUSTODIAN? OF THE DOGS.
AFTER DOING INDEPENDENT RESEARCH, THE
SPECIAL MAGISTRATE WAS NOT ABLE TO FIND
A USEFUL DEFINITION OF WHAT BEING A
?CUSTODIAN? OF AN ANIMAL MEANS. THE
SPECIAL MAGISTRATE WILL BE MEETING WITH
THE BOARD OF COUNTY COMMISSIONERS TO
ADDRESS THIS PARTICULAR ISSUE, AND TO
GET A BETTER UNDERSTANDING AND
DEFINITION OF THE WORD ?CUSTODIAN?. THE
SPECIAL MAGISTRATE FURTHER RULED THAT
SHE COULD NOT ALLOW THE SOUND DECIBEL
LEVEL READINGS THAT THE CODE ENFORCEMENT
OFFICER HAD SUBMITTED FOR EVIDENCE, DUE
TO HER TESTIMONY THAT ANOTHER OFFICER
WAS WITHIN A 10 FOOT RADIUS DURING THE
TIME THE READINGS WERE TAKEN. THE
SPECIAL MAGISTRATE FURTHER STATED THAT
EVEN THOUGH THE RESPONDENT MAY NOT BE IN
VIOLATION OF SECTION 5.6-105, SHE
BELIEVES THAT HE STILL FALLS UNDER THE
EXCESSIVE OR OFFENSIVE NOISE UNDER
SECTION 5.6-106. THE RESPONDENT ASKED
IF, BY THE SPECIAL MAGISTRATES RESPONSE,
THAT HIS PROPERTY IS TO NO LONGER BE
MEASURED USING THE SOUND LEVEL
MEASUREMENT EQUIPMENT. THE SPECIAL
MAGISTRATE WARNED THE RESPONDENT THAT HE
IS JUST LIKE EVERY OTHER PERSON IN
HIGHLANDS COUNTY, AND THAT HE IS ALSO
GOVERNED BY THE HIGHLANDS COUNTY CODE.
THE SPECIAL MAGISTRATE PROVIDED THE
RESPONDENT WITH A COPY OF SECTION
5.6-108 OF THE CODE THAT STATES THAT THE
RESPONDENT MAY APPLY FOR A WAIVER THAT
WOULD GIVE HIM RELIEF OF THE MAXIMUM
ALLOWABLE SOUND LEVEL READINGS. THE
RESPONDENT ALSO REQUESTED CLARIFICATION
OF THE SPECIAL MAGSITRATE?S
INTERPRETATION OF WHERE THE DECIBEL
LEVEL READINGS SHOULD BE TAKEN, ARE THEY
TO BE TAKEN FROM THE PROPERTY LINE

WAS THERE AND FOUND THAT HE WASN'T HOME.
